If you purchase GDL objects from QWSoftDraw® LLC then you agree to be bound by the following "Terms of Agreement" as set forth by QWSoftDraw® LLC: The QWSoftDraw® LLC GDL objects purchased on this website are the sole property of QWSoftDraw® LLC and cannot be sold or given to any third party for any reason. You are allowed to use the GDL object(s) on computers within the company that purchased the GDL object(s) but must pay for additional copies for business use in other companies that did not purchase the GDL objects. For example, if the GDL object(s) is/are bought by "Company A", then "Company A" can use them on their computers, but "Company B" has to purchase them separately even if "Company A" and "Company B" are owned by the same group, person or persons. QWSoftDraw® LLC can change this "Terms of Agreement" without notifying you. It is your responsibility to periodically read this "Terms of Agreement". This "Terms of Agreement" is binding between anyone who purchases GDL objects from QWSoftDraw® LLC, whether the GDL purchaser reads or does not read this "Terms of Agreement". You agree to use these objects at your own risk and will not hold QWSoftDraw® LLC liable for any damage that may be done from using these objects or trying to make them work whether the damage be real, imagined, special, consequential, collateral or incidental. To the best of QWSoftDraw® LLC's knowledge, the GDL objects that are being sold on this website do not contain any viruses, trojans, or other malicious software that would bring damage to computer hardware or software. You agree that QWSoftDraw® LLC will not be liable for any damages done by malicious software that may accidentally become connected to the GDL objects you purchase from QWSoftDraw® LLC. QWSoftDraw® LLC will not give any refunds for GDL objects that are purchased from QWSoftDraw® LLC. All GDL objects purchased from QWSoftDraw® LLC are tested and guaranteed to work in the version of Archicad® they were designed for before they are sent to you the purchaser. After sending you an email with the GDL object(s) attached that you purchased, QWSoftDraw® LLC will not be responsible for: 1.) any malfunction of your email system which prevents you from receiving the emails from QWSoftDraw® LLC with the purchased GDL's attached 2.) software on your computer or your internet service provider that block emails coming from QWSoftDraw® LLC thus preventing you from receiving the purchased GDL object(s) 3.) installation of the GDL objects onto your computer 4.) Archicad® locating your GDL object(s). It is your responsibility as a GDL purchaser to know how to install the GDL object(s) correctly on your computer in order for Archicad® to find the GDL object(s) correctly. However, you can go to QWSoftDraw® LLC's F.A.Q. page for help with installing GDL objects correctly. Even though QWSoftDraw® LLC thoroughly tests the GDL objects before sending them to you, there may still be undiscovered glitches in the GDL computer code. If these glitches keep the purchased GDL object from working correctly, please notify QWSoftDraw® LLC about the clitch and you will receive a free, corrected version of the same GDL object in the same Archicad® version and operating system it was originally purchased in. QWSoftDraw® LLC is not liable for any malfunctions that happens to software or hardware on your computer if you attempt to use a GDL object in an Archicad® version or operating system that the GDL object was not designed for. QWSoftDraw® LLC is not responsible for replacing any GDL object you purchased if you lost it for any reason whether it was because of a computer crash, physical destruction of the computer hardware or software, virus, or anything else that would cause you to lose the GDL object. You are responsible for making a backup copy of the GDL object(s) you purchase and storing the backup in a safe place. PayPal is not liable for any malfunction of QWSoftDraw® LLC's products or services. PayPal and QWSoftDraw® LLC are two separate companies that provide separate products and/or services from each other. In the same way, QWSoftDraw® LLC is not liable for any malfunction of PayPal's products and/or services. If you have a conflict with QWSoftDraw® LLC arising from the purchase of GDL objects from QWSoftDraw® LLC, then you agree that the very first step to try to resolve the issue is to communicate directly with QWSoftDraw® LLC via email or telephone without taking legal action against QWSoftDraw® LLC. In the unlikely event that you cannot get an issue resolved with QWSoftDraw® LLC via email or telephone involving the purchase of QWSoftDraw® LLC GDL Objects, then you agree that the second step of trying to resolve the conflict is to participate in an arbitration process outside of the legal court systems. The arbitrator will be a neutral third party located in or near Blounty County, Tennessee, and the arbitration process will be held in or near Blounty County, Tennessee. You agree to waive all rights to any financial reimbursement from QWSoftDraw® LLC which arises from the arbitration process. Since QWSoftDraw® LLC sells GDL objects on an international level, it is understandeable that if you live too far away and cannot physically be a part of the arbitration process that you still agree to be a part of the arbitration process via email or telephone. In the unlikely even that the arbitration process does not settle a legal matter between you and QWSoftDraw® LLC, you agree that legal action will be held against QWSoftDraw® LLC in or near Blount County, Tennessee. The judgements made will be governed according to the laws of Blount County, Tennesse and the State of Tennessee. You agree that the most QWSoftDraw® LLC or its owner, Byron P. Hartzler, will ever owe you is nothing more than the total cost of the GDL Object(s) you purchased minus the fees that PayPal charges QWSoftDraw® LLC for using its Shopping Cart and Checkout Process.
